VIMOTION AI is a trade name of Verisance Corporation Sdn Bhd, a company incorporated in Malaysia ("VIMOTION", "we", "us", "our").

These Terms govern your purchase and use of our AI-assisted video production services (the "Services") via https://www.vimotion.io (the "Site").

By placing an order, paying for a tier, or submitting a brief, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you are placing an order on behalf of a company or other organisation, you confirm that you have authority to bind that entity to these Terms.

If you do not agree, do not place an order. Continued use of the Service constitutes acceptance of these Terms.

We produce short-form, AI-assisted videos and related digital assets according to a brief that you submit. Available tiers include:

• Avatar / Entry — custom digital human asset.
• Basic — PPT-style video with AI voiceover.
• Standard — Standard package videos.
• Plus — Plus package videos.
• Customize / Full-Scale — Custom Package videos.

All prices are in US Dollars (USD). Tier specifications, prices, bonuses and timelines on the Site at the moment of payment are the binding scope.

Our flow is pay first, then brief. After you click GET PLAN you will pay via Stripe (card) or Billplz (FPX / online banking). Once payment is confirmed, you will be prompted to submit a 3-step brief (company info, video direction, materials notes).

We will reply to your brief within 1 working day (Mon–Fri, Malaysian public holidays excluded) from admin@vimotion.io to request the materials we need (photos, logo, references, voice samples). You then reply to that email with the materials. We send up to 5 polite follow-up emails if we do not hear from you. After 5 attempts your order is flagged for manual review and may be paused indefinitely until you respond.

The 1-working-day timeline applies to our reply, not the production itself. Production begins once we receive your materials, and final delivery time depends on the tier purchased and current workload. We will communicate any delays.

You are solely responsible for ensuring that:

• The information you submit (company name, email, WhatsApp, brief, materials) is accurate and complete.
• You own, or have a valid licence to use, every photo, logo, voice sample, music track, or other material you provide to us.
• The materials and brief do not infringe any third party's copyright, trademark, privacy, or publicity rights.
• The materials and brief do not promote illegal activity, hate speech, defamation, sexual content, or anything otherwise prohibited by Malaysian law.

You agree to indemnify and hold us harmless against any claim, loss, or liability arising from materials or instructions that breach this clause.

Because every video is custom-produced for you, our refund policy is as follows:

• Before production starts — you may cancel your order and request a full refund within 24 hours of payment by emailing admin@vimotion.io with your order ID, providedwe have not yet started production work on your video. "Production starts" means the moment we begin scripting, asset generation, or editing — typically as soon as we have your materials.
• Once production starts — no refunds will be issued. You will receive the deliverables agreed in the tier you purchased.
• Customize / Full-Scale tier deposit— the $100 deposit becomes non-refundable the moment you accept the written quote. The balance, once invoiced, is non-refundable once the corresponding production milestone has begun.
• Failed deliveries— if we are unable to produce the video due solely to our fault (e.g. we abandon the project), we will refund 100% of amounts paid. This is your sole and exclusive remedy.

Refunds, when issued, are returned via the original payment method and may take 5–10 working days to appear, depending on your bank or card issuer.

Your materials— you keep all rights in the photos, logos, voice samples, and other materials you give us. You grant us a non-exclusive, royalty-free licence to use those materials solely for the purpose of producing your video.

Your delivered video— once final payment for your tier is received and the video is delivered, you receive the right to use the final video for any lawful commercial or personal purpose. We retain the right to keep the underlying project files, prompts, and intermediate AI assets we generated to produce it.

Our portfolio— unless you tell us otherwise in writing, we may display the final delivered video and your company name in our public portfolio, social media, and case studies. If you would like to opt out, email admin@vimotion.io before delivery.

Our Site, brand, and templates— the VIMOTION AI brand, the Site, the workflow, and any reusable script profiles or templates we develop remain our exclusive property.

Our videos are produced using a combination of artificial intelligence tools and human direction. AI tools occasionally produce visual artefacts, inaccurate text, mismatched audio, or imperfect lip-sync. We make commercially reasonable efforts to identify and correct these issues before delivery, but we cannot guarantee a 100% artefact-free output. By ordering, you accept this inherent characteristic of AI video production.

We do not use your private brief or materials to train any third-party model. We do not warrant the factual accuracy of any AI-generated text or imagery; you are responsible for reviewing the final video and pointing out factual errors during the review window communicated with each delivery.

To the maximum extent permitted by Malaysian law, our aggregate liability arising from or relating to your use of the Services is limited to the amount you actually paid us for the order in question. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, business opportunities, or data.

Nothing in this clause limits any liability that cannot lawfully be excluded under Malaysian law (such as liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence).

We may suspend or terminate your access to the Service, refuse to start or continue production, and (where permitted) retain or refund amounts paid, if you breach these Terms, submit unlawful or infringing materials, or fail to respond to our materials request within a reasonable time.

We may update these Terms from time to time. The version in effect on the date of your purchase governs that order. For ongoing customers, we will give reasonable notice of material changes via email or via the Site.

These Terms are governed by the laws of Malaysia. Any dispute arising out of or in connection with these Terms or the Services is subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia. Before filing any claim, you agree to first contact us in good faith at admin@vimotion.io and attempt to resolve the issue informally for at least 30 days.
